Who Is The Father?

...The saga of a Minnesota Fairview Hospital System Physical Therapist

[Kent]

Kent - 1st Christmas 1989

Anyone who knows Jim Adams personally will instantly see his likeness in this picture. This child is unquestionably his son. It still astonishes me how I was so blinded by my excitement...that I did not recognize it immediately. It is a small wonder that Nancy (with hindsight) appeared to be a "walking time bomb" of anger...in fear of the day the truth would be discovered.

"If society depends for it's existence on certain rules governing what may be combined and what should be kept separate, then adultery, by bringing the wrong things together in the wrong places (or the wrong people in the wrong beds), offers an attack on those rules, revealing them to be arbitrary rather than absolute". Tanner 1979

I still find it curious how I remember the exact moment I met Jim Adams...

The reason for the previous statement warrants an explanation.

I first met Nancy through my ex-wife. They worked as "Certified Corrective Therapists" in the Rehab department of the Houston Veteran's Administration (VA) Hospital on Holcombe Boulevard. After working together for several months, my former wife (Judy) and Nancy became good friends.

After only a few months of working at the Houston V.A. hospital...Judy began telling me of the horrible arguments and the abuse that Nancy was reporting that she was suffering from her husband David. (David was a huge guy...and a former starting tackle for the University of Miami Hurricanes football team. Miami was ranked "number 1" when David played for them.) Having met David...I was somewhat distressed at hearing this news.

Judy also began telling me of how Nancy had began frequently having lunch with a patient who was old enough to be her father. The man was an attorney who lived in the affluent "Memorial" section of Houston. He came to "come for his treatment" at the V.A. in his motor home. There were rumors beginning to spread around the hospital.

Over several months...Judy told me of Nancy becoming involved with still another older male patient.

In the summer of 1978, the "Memorial patient" invited the entire V.A. Corrective Therapy department to his home for a "pool party" in his backyard. Judy and I attended the party with the rest of the staff. I do not remember the man's name...but I do remember how he and Nancy flirted with each other the entire afternoon. I remember watching David in the swimming pool, playing water polo with "the guys"...apparently oblivious to what was going on up next to the house.

Sometime in the next few months, Judy began telling me of Nancy revealing that she had performed oral sex on the "patient" while parked in his car, at nearby Herman Park.

Over time...I was slowly drawn in to "help" both Nancy and David. It was obvious that their marriage was under extreme distress. I was troubled by Nancy's behavior. It was "telling" to me...and at the same time, "in an effort to help her"...I was slowly drawn to be close enough to become intimate myself.

It now is more than apparent that she has used this tactic with success on multiple occasions.

Nancy once told me that the "Memorial patient" was a diabetic...and having difficulty achieving an erection. (This brings one to wonder just how extensive the "treatment" may be at V.A. Hospitals...not to be facetious...but this subject is beyond what she as a Corrective Therapist would have any interest in knowing...let alone treating).

When Nancy "ran away" in April of 1989...3 month's pregnant...I tried to confide to her brother Randy...just how extreme I thought Nancy's neurosis might be. I hoped to enlist the family in coming to confront Nancy to seek treatment. The idea seriously backfired on me.

After I discussed the problem with her brother Randy on the telephone...he apparently went ballistic...and out of control. (According to Nancy...her brother was "manic depressive" (bi-polar)...and it was clear that he was not able to deal with the news. Nancy confronted the "confrontation" by vehemently denying what I had stated to Randy...and he apparently accepted her lies as the "solution to the problem".

This brings about another "cause for concern" for Nancy. If Randy is in fact "bi-polar"...there is a degree of risk...warranting concern...that she may be afflicted in some manner as well.

Nancy was furious that I had told her brother of the "V.A." affairs.

Several months later, in another conversation with me...she tried to justify her behavior (not deny it)...by exclaiming that..."Ashley,...You know diabetics have a difficult time with erections".

What is clear to me by this time...with the exception of myself...and possibly Steve Kinney (Lorna Kinney's husband)...every man that Nancy has had an affair with...was old enough to be her father....though none have sired children until...

Along comes James Francis Adams....

It should be apparent why I was immediately suspicious of Jim Adams.

I first met Jim on Saturday April 2, 1988.

We had just closed on our new "hobby farm" the day before in Elk River. We had rented the largest U-Haul truck available immediately afterward...and loaded it at our house near Nowthen that evening.

It was now about 9 AM Saturday morning...and I had just turned into our new 400 foot long driveway. Nancy was riding in the cab of the U-Haul with me ...and I was driving.

I looked down the driveway to see a male figure standing near the garage door.

I asked Nancy..."Who is that?"

Her very words were..."Oh...I meant to tell you. That's a patient of mine. He's a nice guy...and he has offered to help us move". (I have learned to be wary of nice guys).

The key words in that statement..."He is a patient"...gave me instant recall about things I was all too familiar with in her past. I would later find out that he not only was a patient...but a back injury patient...and I could not figure out for the life of me...why someone who had ever had a back injury would volunteer to help someone move furniture. IT DID NOT COMPUTE. ( I myself had several back injuries...and although relatively minor...I to this day would not offer to help someone move...back pain hurts too much to risk it).

During the course of the moving...I began to note that Jim always seemed to have disappeared in the house whenever Nancy was inside...but I did not say anything).

There is another impression I got from Jim in the next couple of weeks.

When we first moved to Estes Brook we had about 100 bails of hay which we brought with us from Anoka County. It was about 6 weeks before we finished the barn...and Jim Adams offered to let us "borrow" a heavy duty red tarpaulin to cover the hay with. It was the size and type like that used to cover "open loads" on a full length "semi" trailer.

After we finished the barn, I folded the tarp up and Jim picked it up a few days later. As I helped him load it to take home I commented, "Jim that's a nice tarp. How much is something like that worth...a thousand dollars?"

Jim Adams responded with words (as close as I can recall)"...Oh this one didn't cost me anything...ole United won't miss it". Jim clearly represented to me that he had stolen a very expensive piece of property from his employer. (I have several aerial photographs of the tarp in use as we were waiting to build the barn).

In February of 1989, only a few weeks before our trip to Australia, I re-injured my back. I went to the Rum River Medical Clinic in Princeton and was prescribed "Physical Therapy".

I talked to Nancy about what treatment I needed. Her comment puzzled me at the time...and now seems even more interesting.

Nancy stated that I would have to be treated by one of the other Physical Therapist because, "...the insurance company will reject the claim if the they see both names are the same". This strongly suggests she was familiar with implications of ethics violations...but it apparently did not matter in regards to her child's biological father...because the names were different on the paperwork.

On at least two occasions during my treatment period at the clinic, I was required to wait in the PT lobby area. It was a relatively small section of the hospital at the time...and I vividly recall seeing Jim Adams and Nancy come out of a treatment room together...her carrying a chart...everything appearing to be quite on the "up and up".

The point I wish to make...despite what she would later deny... She in fact was very much involved with Jim Adams as a patient. She not only introduced him to me as "a patient of mine"...but I personally saw them in a "therapist / patient" scenario.

A couple of months after we moved to the Estes Brook area, Nancy wanted to have a "house warming" party...which was actually more of a "lawn party". Everyone at the party was a member of the hospital staff...except myself, Jim and Betty Adams.

I felt it curious that she invited Jim to what was otherwise clearly a hospital function. I remember Betty as rather quite and withdrawn from conversation the entire time.

There was something else that afternoon that was rather remarkable.

Nancy was letting people ride our horse "Thunder"...who was a fairly small, docile quarterhorse. She was giving a ride to one of the children...when the reins got caught across the top of her hand. The horse jerked it's head down to free itself...and a 1 carat, $4000.00 diamond was instantly plucked out of her engagement ring and flown several feet into a gravel driveway!

There were probably 20 people down on their knees or carefully helping to search...it seemed impossible! We tried sprinkling the drive with the water hose...and any idea people could think of. It was getting on into the afternoon...and we "called off the search" so people could eat.

Sunset was fast approaching by the time we finished eating. Three or four of us went out to "try one more time"...when.. guess who?...found the diamond!

Jim Adams left that day...all present believing he was a hero.

There are several other individuals within the clinic, that could verify these claims...if they were not in fear of vindictive action.

Upon the death of Lorna Kinney in the winter of 1991...Nancy was promoted from Rehab Supervisor to Director of Rehab.

WHAT DO I KNOW ABOUT JIM ADAMS?

[James F. Adams Residence]

The residence of James F. Adams, located in extreme southwestern Isanti County, Minnesota at 28460 Tiger Street NW, which is in the Zimmerman post office area. He enjoys "lakefront living", with the rear of the residence having several hundred feet of waterfront property. He is most commonly seen driving the red and black Suzuki Samari, seen in the photo. (Minnesota license 697 CIZ) The building to the right houses additional vehicles, motorcycles and boats. [ GPS location: 4529.159N 9329.504W ]

James Francis Adams was born on August 9, 1937. (He is 6 years older than me...and 13 years older than Nancy). His physical description from his Minnesota driver's license indicates that he is 5 foot 9 inches tall, weighs 200 pounds, has brown eyes...and wears glasses.

He has a penchant for showing up inappropriately dressed in "muscle shirts. In federal court he showed up in jeans and a pull over shirt....suggestive of being a "show of status as a have not" at the direction of his attorney. When I filed a complaint against him in Isanti County Court...he miraculously showed up in a 3 piece blue suit (with tacky cowboy boots).

If you look at the above picture of Kent...he has a remarkably similar shaped face...with a graying, dark hair. Just imagine the face in the picture...and age it 60 years!

Jim's primary mode of transportation is a red Suzuki Samarai (similar to a small jeep) with a white (sometimes black) top. The Minnesota license plate is 697 CIZ.

He owns several other vehicles...including a motorcycle...and a black Corvette. (He sold a large van several months ago. He also has a boat and several canoes...and lives on the east shore of a lake in extreme southwestern Isanti County, Minnesota).

He has formerly been employed as a truck driver...with the more significant worker's comp claim filed against United Van Bus of Minneapolis.

When I became convinced of Jim Adams involvement with Nancy, I called Betty Adams to obtain some background information. She advised me the location of his employer and working schedule. I advised her that I was going to hire a private detective (in addition to the one from Sentry Insurance) and that I was willing to share any and all information I learned in appreciation for her assistance.

It was obvious that Betty was extremely pained...but also was convinced enough at the evidence I presented her that she was willing to help.

I called Betty a couple of days after the D.N.A test results came back. As badly as I felt...I did not want to do it...but since I had promised to share information...I did not feel right about withholding the results from her. I felt very much what it must be like for a law enforcement officer to have to go to someone's home and tell them of a death of a member of the family.

The most memorable impression I remember about the moment that I told Betty... was the silence...

I felt so badly for her. She had been married to Jim for 30 years. Betty's silence conveyed to me her horror and pain...without so much as a sound being made.

To consider the subject of adultery without considering the emotional tragedy on it's victims...is among the greatest of travesties of our society, which has evolved today. It yields every bit as much pain and suffering to it's victims as many crimes punishable by lengthy prison terms...and yet it does not carry the implicated stigma of even a parking ticket in most state courts.

Jim divorced his wife Betty as a consequence of the "fall out" of his involvement with Betty.

I obtained a copy of their divorce decree at the Isanti County Courthouse in Cambridge. Jim seems to have "taken care of everything". It appears as though Betty may have been too traumatized by the discovery the extent of his involvement with Nancy...for she apparently did not have the capacity to confront Jim with separate legal counsel. The document indicated that Jim would keep his entire worker's compensation income. It also indicated that Betty made considerably less that $20,000. a year working as a beautician in Coon Rapids. Jim and Betty were married 30 years...and he left her with virtually nothing.

Jim "works" part time at the Coast to Coast Hardware store in Elk River...under administratively "shortened hours"...because of his disability. The last time I checked, he only worked about 10 hours a week....and was complaining of having to be on his feet too much.

Jim does well in his "part time job".

Jim has filed FIVE worker's compensation claims against 3 separate insurance companies. The "worker's comp" income is not taxable. Adjusting for taxes...you and I would have to make the equivalent of $68,000. a year to take home what Jim Adams does.

What is curious about Jim Adams injury claims is...he always went to the same doctor for diagnosis.

He also has a rather unusual relationship with his Physical Therapist.

I alerted the State of Minnesota of this unusual relationship.

The State referred me to Sentry Insurance Company...who hired a private detective. It seems that, unknown to me, Jim was in the process of suing Sentry Insurance for another $250,000.00 for "pain and suffering". Sentry insurance was most interested in the relationship Jim had with Nancy.

What may not be apparent to the reader...or even the medical investigators in this situation...is that Nancy is very highly regarded in her field. She is very well professionally thought of by the physicians in Princeton. Nancy has told me of repeated occasions...only a few months after she had graduated from Physical Therapy school at the University of Minnesota...that the doctors were writing orders for her to "Evaluate and Treat". Professional courtesy dictated that Nancy keep the doctors posted as to what she was doing. In truth...the doctors were involved to only a minor extent. The paperwork would indicate otherwise...but it's a nice arrangement...and the patient normally has no reason for concern.

The purpose of the above example is to show that Nancy has a far greater input as to the type and extent of care which Jim Adams received...and an abnormally high level of influence and input as to the validation of his disability.

I have no hard evidence there were ever any financial ties to this scheme...but it certainly warrants suspicion.

What I do know...is that when the Minnesota State Attorney General Investigator Mark Bukowski showed up at the hospital to conduct an investigation on behalf of the Medical Ethics Board...and ALL OF JIM ADAM'S MEDICAL RECORDS WHICH LINKED HIM TO ANY TREATMENT FROM NANCY...WERE MISSING.

Someone had removed the files...? (Remember...since the death of Lorna Kinney, Nancy was now the Director of Rehab at the hospital. She would have access to information at the highest levels. She also had the influence to intimidate anyone who would have been willing to talk...and I KNOW of at least three people who hold such information within them).

During the time Jim Adams was being investigated by Sentry Insurance, I got a phone call from their private detective asking if I my detective had been following him tow days earlier. I replied that he had not...Why? He said that Jim Adams had filed a complaint that he had been followed...and was blaming the caller. I then laughed...for it was then apparent that somebody else also had a stake in Jim Adams!

I have long been of the opinion what Jim Adams possesses a seriously flawed sense of integrity. It somehow seemed justified to think that he apparently was growing paranoid...believing he had all sorts of people following him. We both agreed...he deserved it... Then we were left to contemplate who else he was trying to defraud.

Of further interest...I am in possession of a lengthy video tape made by a private detective. He explained that he "crawled on his belly for a quarter of a mile through a corn field in a camouflage suit" to get the pictures.

The video tape clearly shows Jim Adams in the process of painting Nancy's (MY) house...while standing on the top of a 20 foot extension ladder. He repeatedly leans, bends, extends and distorts his body as he tries to paint under the eaves of the two story garage section. (The house used to yellow..Jim painted it gray).

Several times in the course of the video tape. Jim descends to the ground. Without lowering the ladder, he moves it repeatedly, holding it out and away from his body as he steps to the side. Imagine the stresses subjected to the back during this process....

The video tape also shows another individual present for the painting project. The individual is his physical therapist...standing on the ground in a bikini bathing suit...looking on as he works. (If I could only figure out how to post the video tape on the WWW...)

On a relatively recent occasion I witnessed Jim Adams cutting up and moving the remnants of a large Red Oak tree in his front yard...picking up and splitting sections of extremely dense, heavy oak logs I would estimate to be more than 3 feet thick.

I was asked by an attorney representing Sentry Insurance Company if I would agree to testify at his "Pain and Suffering" lawsuit.

Jim Adams appears to have had no prior knowledge that I had any involvement in the case what-so-ever.

The hearing was held in the Federal Courts Building in downtown Minneapolis.

I was asked to be present at 9 AM on the date of the hearing.

I arrived in downtown Minneapolis with only moments to spare. I walked into the lobby of the Federal Building and immediately identified the elevator which I needed to board to go to the 11th floor...the door was open and it was nearly full. I rushed into the crowded elevator...and turned around to face the door...just as it was closing.

Once we reached the 11th floor, the elevator door opened...As I stepped forward...and it seemed as though a rush of air had just blown by me. I looked to my left just in time to see Jim Adams running for the bathroom! (Dressed in "blue collar" regalia of course).

Jim Adams had been in the rear of the same elevator...and apparently had just realized that his scheme to collect a quarter of a million dollars from Sentry Insurance...had just gone down the tube...!!!

Jim Adams was so upset at my presence...that the first motion made to the judge that morning was to have me removed from the courtroom..."As the presence of a witness for the opposition is overwhelming Mr. Adams's ability to remain calm" (or words close to that effect).

I sat by the entrance to the courtroom and was able to hear much of the proceeds through the open door.

The attorney for Sentry Insurance came to me during a recess and asked if I still was willing to testify. He went on to state that my "mere presence" had so "blown away" the Adams position...that he did not have a prayer of winning the case. I agreed to wait around until the end of the hearing..."just in case"...but never did actually get called to the witness stand.

I later purchased a complete, typed transcript of the hearing. which cost me in excess of $200. The information gleaned from testimony that day had proven very interesting...

Fingering Jim Adams as the father...

Prior to continuing, it is important to understand, that very early in our separation in the winter of 1992, Nancy provided a sworn, witnessed and notarized letter, written by Princeton attorney Thomas J. Meinze, declaring the fact that Kent was "born to this marriage" which in effect was the ground work and basis of soliciting "parental support".  It is extremely obvious that, without question, Nancy knew she was lying at the time, which is, by any definition, an act of perjury.  In doing so, Nancy was attempting to STEAL more than $250,000. in child support. Only later, owing to a growing list of outrageous charges and lies, was I motivated to obtain a D.N.A. paternity test. Judge Steven Ruble totally ignored the attempt at theft and perjury *.

    * Perjury - defined by Webster as " The deliberate , willful giving of incomplete, misleading or false testimony under oath.

Prior to he divorce hearing, armed with the evidence of the D.N.A. test, I established with attorney Mike Williams that he was to ask Nancy to identify the biological father while on the witness stand. IE, I was compelling her to admit she had been lying. Based on her response, she apparently believed that I had no idea who the father was...

The "Dissolution Hearing" of Nancy and myself, which was held at the Mille Lacs County courthouse, was presided over by Judge Steven Ruble. (I later learned that Ruble had a daughter on the swim team at Princeton High School with Sandy Lynn Thompson...(Nancy's daughter)...and there was strong evidence to suggest that Nancy and Ruble knew each other. Parents of such relatively small teams like this frequently drive or travel to out of town sporting events together. In the very least they sit together in the grandstands. Nancy also indicated that he had been a patient at the clinic...although it was not suggested that Judge Ruble was her patient. Only after several court sessions had transpired...and I made the accusation in writing, did Ruble recuse himself in further involvement in our hearings).

There were only seven people present in the courtroom that morning. These individuals were Judge Steven Ruble, the court reporter, Nancy, myself, Nancy's Attorney (Tom Meinze) and my attorney (Mike Williams)....and Nancy's supervisor, Lorna Kinney. (Apparently believing that she was "helping a friend").

Note: Almost immediately after Lorna's death...Nancy and Steve Kinney were clearly seen everywhere together...and Jim Adams seems to have been displaced by the much younger (athletic) Steve. Consider this...Nancy got Lorna's job...and her husband... What about the 80 acre Kinney farm in Kanebec County, 10 miles east of Milaca? I have since heard both Nancy and Sandy's voice recorded on Steve Kinney's telephone answering machine.

Nancy had repeatedly lied about property and personal possessions. It was apparent to me that there was going to be a struggle if we were going to get to the "truth of the matter" ...but good old Ruble made sure that did not happen...either ignoring or pretending to be confused by the evidence. He caught Nancy lying in an inventory of property...then turned around and openly admitted to punishing the offender as stated in our divorce decree....the problem is...he assumed the lying party was me...further displaying unabashed polarity to Nancy's interest. Forgive me for expressing the thought...but after all of this fiasco...perhaps you can understand if I wonder if Ruble is a nice guy too?

As I once heard an old Texas politician say..."If it looks like a pig, smells like a pig...You can put lipstick on it...but it's still a pig".

Lorna Kinney was asked to testify about what property I had taken...in an apparent maneuver to establish that I had removed my share of belongings. In truth...Lorna had known us only about three years...and at that time we were married almost 12 years...and Lorna had no idea of when anything had been purchased. The fact was...I had only taken things that were pre-martial property.

It was rather naive of Lorna to believe she could be a credible witness...but by then Nancy was in the equivalent of a manipulative feeding frenzy...and there would be many, many more others who would be drawn into her scheme...none of whom appeared the least bit informed or even suspicious.

Lorna Kinney was dismissed and left the courtroom. I am suspicious that Nancy did not want her to know what was going to be discussed later. (Lorna died barely more than a month after our divorce hearing of a "rare blood disorder").

Next...Nancy was seated in the witness chair and had been sworn in ...

I had one specific issue that I wanted to resolve...if there was nothing else resolved that day. I instructed Mike Williams that he was to ask Nancy to..."Name the individual with whom you had sexual intercourse at the appropriate time for the child William Kendall Waters to be conceived".

Tom Meinze stood up immediately to object to the request.

The two attorneys quickly escalated into an argument before Judge Ruble...with Tom Meinze exclaiming, "Why should she have to answer that question? What good is it going to do?"

Mike Williams responded with words to the effect, "My client wishes to reserve the right for further legal action. This issue can not be argued in another arena...it must be resolved here".

Judge Ruble responded with a statement, "I am not sure if I can make a ruling on this issue. I will do some research during our next recess".

During the heated debate...which lasted several minutes...I looked towards Nancy who was still seated in the witness chair. She looked at me...and made the first eye contact we had in several months....as she mimed with great facial distortion..."I - HATE -YOU".

Later I asked Mike Williams if he had seen what she had done...and he had not. Apparently I was the only person to witness her display of anger. That's probably the way Nancy wanted it...

After the recess, Nancy was still seated in the witness chair.

Judge Ruble immediately brought up the subject which he had now researched.

He turned to his left to face Nancy...and then began to explain...( without notes or transcript, I will try as best I can to accurately represent the statement). "Every so often Judges have to do something we really don't like to do. I have researched the issue...I am very sorry, but I am ruling that the opposition has the right to ask the question).

At this point in time...I am sitting there thinking...

"WHY ARE YOU APOLOGIZING TO THIS WOMAN BECAUSE SHE HAS TO ADMIT TO HER ADULTERY?

WHAT ABOUT MY SON?

WHAT DO YOU THINK IT IS LIKE TO HAVE YOUR SON TAKEN FROM YOU IN THIS MANNER?

WHY ARE YOU TOTALLY DISREGARDING....MY FEELINGS?

YOU APPARENTLY ARE WILLING TO HOCK YOUR SOUL IN ORDER TO APPEAR POLITICALLY CORRECT BEFORE THE WOMEN'S MOVEMENT."

The blatant display of the lack of a "neutral" position almost defies the ability to convey to the reader...

Something then occurred in the court room that I had not expected...

Mike Williams...in a moment of brilliance, again started the questioning...about all sort of relatively mundane matters. Having been given the right to ask the question...he seemed to be deliberately asking any and all sort of questions...except that one....apparently in an effort to keep Nancy off balance.

It was more than apparent that the question was eventually going to get asked.

After almost another hour of testimony by Nancy, Mike Williams again asked the question, "Name the individual with whom you had sexual intercourse at a time appropriate for the child William Kendall Waters to be conceived?"

Nancy again made eye contact with me. She produced a nervous smile, unsuccessfully trying to conceal a sense of arrogance.

It was as though for a moment in time...there was complete silence in the courtroom and nobody else was present.

Nancy continued to make eye contact with me as she stated, "Well Ashley..I guess you want to know....Jim Adams".

Under my breath...I wished I could have stated..."No shit!" ..."Do you think I am surprised?" "I guess you have no idea what I already know?" "You must think I am some sort of a fool?" "I just wanted you to have to be confronted with the truth...I wanted YOU to have to say it?"

After a moment, I found myself once again feeling compassion for Nancy. She may never in her life have been confronted in this manner. I did not like doing that...and I don't think anybody else present liked being a part of it.

Underlying all of this...is the need to confront somebody you care about...because you want them to be well and happy.

It is our nature to avoid the unpleasant.

It is also our nature to confront what is wrong.

Sometimes the choice is removed.

Sometimes it takes an extraordinary effort to prove to someone that you care...
